The Phantom of The Bay – Terms and Conditions
Method of Entry
A competition organised and executed by The Bay, to run in play Monday to Friday between 08.30 and 17.00 from 16th August to 27th August 2010 inclusive.
Pre-Promotion runs from Monday 19th July to Sunday 15th August inclusive.
There is one person who has been appointed and nominated by The Bay as The Phantom of the Bay.

NOTE: The Phantom of the Bay will be dressed in normal clothing.

The Bay may at its absolute discretion at any time replace The Phantom of the Bay with another person or persons selected by The Bay.

During the term of the competition The Bay listeners will be invited to identify The Phantom of the Bay. In addition, if a listener feels that they have identified someone whom they believe is or might be The Phantom of the Bay they will be entitled to ask that person the question ‘Are You The Phantom of the Bay?’. If that person is The Phantom of the Bay and has been questioned during a bounty period, it will be acknowledged and that contestant will win the nominated prize/ bounty for that bounty period.
There can only be one winner in each bounty period.

Once identified, The Phantom of The Bay will pass the person identifying the Phantom of the Bay a card to call The Phantom of the Bay dedicated hotline and the person identifying The Phantom of the Bay will be required to confirm a special code, only displayed on that day’s bounty winner’s card and to provide various personal details over the telephone. Payment of the bounty will be by cheque payment within 30 days of the bounty having been awarded. No cash payments will be made.

The Bay will during the period of the contest nominate specific times during which listeners may approach people whom they believe is or might be The Phantom of the Bay. These will be stated on air as Monday to Friday between 8.30am and 5pm.

In addition, once any person has won a bounty by successfully questioning The Phantom of the Bay, the competition will cease for that bounty period and the prize cannot be won until the next bounty period is announced on air by The Bay.

In the event that more than one person approaches and questions The Phantom of the Bay, the winner of the bounty will be the person who asks first. If more than one person asks at the same time, the bounty will be divided equally between these people. All decisions as to which person has questioned The Phantom of the Bay first or which persons have questioned The Phantom of the Bay at the same time will be at the absolute discretion of The Phantom of the Bay and no correspondence will be entered into.

Important Information

No person who approaches and/ or questions The Phantom of the Bay will be answered truthfully or will win a prize if the following apply:

- They have done so outside of a bounty period nominated by The Bay
- The Phantom of the Bay is travelling in private transport
- The Phantom of the Bay is in a private residence or place of accommodation
- The bounty has already been won for the nominated bounty period

Safety
- The Phantom of the Bay will never hide in a park or playground
- A listener pursues The Phantom of the Bay at their own risk
- All listeners pursuing The Phantom of the Bay must do so safely, observing speed limits and must ensure that they do not endanger themselves or others in the pursuit of The Phantom
- Participants must behave responsibly and within the law at all times
Duration
The competition will run weekdays between 08.30am and 5pm from Monday 16th August to Friday 27th August 2010. The Bay may at its absolute discretion extend the competition or end the competition early – if this decision is taken it will be announced on air.
The Bounty
Prior to the commencement of each bounty period, The Bay will nominate a bounty that will apply for that nominated time period. The amount of the bounty will vary between periods over the term of the contest.
If the bounty is not claimed within the valid time period then it will roll over and be added to the next bounty. In the event that the remaining bounty is unclaimed by the end of the competition at 17.00 on Friday 27th August, it will be donated by The Bay to a nominated local charity or charities of its choice.
Prizes
All prizes are non transferable.
Entry
  Where any person has won any prize in this competition they will be disqualified from competing in this competition again.
Publicity
It is a condition of entry that The Bay has the right to publicise the names, characters, likenesses or voices of any contestants for any promotion or matter incidental to the competition.

The winner may also be required by The Bay to participate in a photo, video and/or film session and acknowledges that The Bay has the right to use such publicity photos, videos and/or films in any medium and in any reasonable manner it sees fit.

Contestants consent to their entry being read out on air and to their telephone and other conversations with The Bay being broadcast.
Notification
All prize winners will be notified by telephone when they have identified The Phantom of the Bay
Winners
Winners will be confirmed only by The Bay and we will endeavour to dispatch prizes within 30 days.
General
Employees and their immediate families of The Bay are ineligible to enter. Friends and relatives of The Phantom of the Bay and employees and their immediate families of all associated sponsors and participating companies are also ineligible to enter. Employees of CN Group and all its divisions and their immediate families are also ineligible to enter.
Age Restrictions
All entrants must be over the age of 18.
Termination
The Bay may terminate this competition at any time at its absolute discretion without liability to any contestant or other person.
Decisions
In all matters, all decisions of The Managing Director of The Bay will be final and no correspondence or discussions will be entered into.
Agreement to Terms and Conditions
By entering this competition all entrants agree to be bound by these terms and conditions and our standard competition terms and conditions which are governed by law.
